Adv Ntsikelelo Sipeka (ACIBM) is an energetic, independent self-starter, legal visionary, business executive, governance specialist of over twenty-one (21) years, combined experience in legal advisory services, litigation, compliance, risk management, policy formulation, corporate governance, and general boardroom administration. He has been a Company Secretary and an executive manager for more than thirteen (13) years. Amongst positions held is as a practicing legal practitioner, Legal Advisor, Claims Handler and Litigation Officer at the Road Accident Fund, Company Secretary, Head of Department Legal and Governance, Acting General Manager: Professional Boards, Head of Department Executive Company Secretariat, Acting Head of Department Legal and Regulatory Affairs and Acting Registrar/CEO. Has had exposure to leadership and management in the public sector companies and regulation environments.
As a Head of Division Executive Company Secretariat at the Health Professions Council of South Africa, he was responsible for governance, compliance and administrative support to a Council, Professional Boards, and their committees. Led and managed a division of 49 staff members with 6 Deputy Company Secretaries as direct reporting subordinates. He was the Acting Head of Department Legal and Regulatory Affairs of the HPCSA and overseeing a department of 60 staff members. He further acted as the Registrar (CEO) of the HPCSA until the end of April 2023, responsible for implementation of the Council strategy and Annual Performance Plan targets amongst other responsibilities.
Additional to his governance and secretariat functions, he was responsible for leading, directing and coordinating the business and legal affairs of the organizations he worked in and made sure that they were insulated from governance, legal and compliance risks.
He was further responsible for negotiation, vetting and general management of contracts to avert the risk of litigation. This role also involved appearance in the CCMA and other labour law forums.
He was also a Head of Governance and Legal Counsel for the Association of Medical Councils of Africa (AMCOA), where he was responsible for legal, governance, risk and compliance functions for medical councils across the continent and to individual member states. He developed governance and regulatory frameworks for the association. Played a pivotal role in inculcating an ethical leadership culture through training of the member states members of the governance structures of AMCOA.
He possesses vast experience in the regulatory environment, having worked at the HPCSA which is regulatory body in the health sector and being appointed in 2013 by the then Honourable Ministers of Transport, Dikobe Ben Martins and later Dipuo Peters to serve as a member versed in law in the Economic Regulation Committee for both Airports Company of South Africa (ACSA) and the Air Traffic and Navigation Services (ATNS) SOC Limited. In this regard he gained experience in Civil Aviation and Economic Regulation.
The Economic Regulation Committee is an independent statutory body that oversees the economic regulation of the Airports Company South Africa and the Air Traffic and Navigation Services. The principal objectives of the Regulating Committee are to restrain these two companies from abusing their monopoly and promote the reasonable interests and needs of the users of services whilst ensuring that the regulated companies can finance their obligations and have a reasonable prospect of earning a commercial return.
He has a full grasp of development of organisational policies and strategies and public sector policy management. This has been further enhanced by a Master’s Degree in Development Studies.
He was admitted Advocate of the High Court of South Africa in November 2018 and has litigation experience in both the Magistrate’s and High Courts. He did Pupillage and passed the Bar Admission Examinations and was called to the National Bar Council of South Africa (NBSA) in July 2020 .He has passed the Practice Management Course (PMT) of the Law Society of South Africa allowing him in terms of section 85(1)(b) of the Legal Practice Act 28 of 2014 to practice as an advocate in possession of a Fidelity Fund certificate and has also maintained an independent practice as an Advocate .
Adv Ntsikelelo Sipeka (ACIBM) is armed with a BJuris, LLB, LLM (Corporate Law), MA (Development Studies), Postgraduate Diploma in Corporate Law, Postgraduate Diploma in Labour Law, Certificate in Corporate Governance, Certificate in Compliance Management.
He is an Associate Member of the Institute of Chartered Business Management with the (ACIBM) professional designation, member of the Institute of Directors, member of the Black Lawyers Association, member of the Black Management Forum, registered with the Legal Practice Council of South Africa and a member of the National Bar Council of South Africa.
